However, we reserve the right to check the server log files retrospectively if there are concrete indications of illegal use. Consequently, there is no possibility for the user to object.
3. Cookies
The Matsushima GmbH website uses cookies. Cookies are text files that are stored on a computer system via an internet browser. Numerous websites and servers use cookies. Many cookies contain a so-called cookie ID. A cookie ID is a unique identifier for the cookie. It consists of a string of characters that can be used to assign websites and servers to the specific internet browser in which the cookie was stored. This enables the websites and servers visited to distinguish the individual browser of the person concerned from other internet browsers that contain other cookies. A specific internet browser can be recognised and identified via the unique cookie ID. By using cookies, Matsushima GmbH can provide users of this website with more user-friendly services that would not be possible without the use of cookies. Cookies enable us to optimise the information and offers on our website for the benefit of the user. As already mentioned, cookies enable us to recognise the users of our website. The purpose of this recognition is to make it easier for users to use our website.
The data subject can prevent the setting of cookies by our website at any time by means of a corresponding setting in the Internet browser used and thus permanently object to the setting of cookies. Furthermore, cookies that have already been set can be deleted at any time via an Internet browser or other software programmes. This is possible in all common Internet browsers. If the data subject deactivates the setting of cookies in the Internet browser used, not all functions of our website may be fully usable.

When you contact us (e.g. by telephone or email), personal data is collected. This data is stored and used exclusively for the purpose of responding to your enquiry or for establishing contact and the associated technical administration.
The legal basis for the processing of the data is our legitimate interest in responding to your request in accordance with Art. 6 (1) lit. f GDPR. Insofar as we obtain the consent of the data subject for the processing of personal data, Art. 6 (1) lit. a EU General Data Protection Regulation (GDPR) serves as the legal basis.
When processing personal data that is necessary for the performance of a contract to which the data subject is party, Article 6(1)(b) GDPR serves as the legal basis. This also applies to processing operations that are necessary for the implementation of pre-contractual measures.
Insofar as the processing of personal data is necessary to fulfil a legal obligation to which our company is subject, Art. 6 para. 1 lit. c GDPR serves as the legal basis.
In the event that vital interests of the data subject or another natural person require the processing of personal data, Art. 6 para. 1 lit. d GDPR serves as the legal basis.
The personal data of the data subject will be deleted or blocked as soon as the purpose of storage no longer applies. Storage may also take place if this has been provided for by European or national legislators in EU regulations, laws or other provisions to which the controller is subject. The data will also be blocked or deleted if a storage period prescribed by the aforementioned standards expires, unless there is a need for further storage of the data for the conclusion or fulfilment of a contract.
5. Use of social media: social plugins
Facebook as standard plugin
Our website uses social plugins (‘plugins’) from the social network Facebook, which is operated by Facebook Inc., 1 Hacker Way, Menlo Park, CA 94025, USA (‘Facebook’). The plugins are marked with a Facebook logo or the addition ‘Social plugin from Facebook’ or ‘Facebook Social Plugin’. An overview of the Facebook plugins and their appearance can be found here: https://developers.facebook.com/docs/plugins
When you visit a page on our website that contains such a plugin, your browser establishes a direct connection to Facebook’s servers. The content of the plugin is transmitted directly from Facebook to your browser and integrated into the page. Through this integration, Facebook receives the information that your browser has accessed the corresponding page of our website, even if you do not have a Facebook profile or are not currently logged in to Facebook.
This information (including your IP address) is transmitted directly from your browser to a Facebook server in the USA and stored there.
If you are logged into Facebook, Facebook can immediately associate your visit to our website with your Facebook profile. If you interact with the plugins, for example by clicking the ‘Like’ button or posting a comment, this information is also transmitted directly to a Facebook server and stored there. The information is also published on your Facebook profile and displayed to your Facebook friends.
The data processing operations described are carried out in accordance with Art. 6 (1) lit. f GDPR on the basis of Facebook’s legitimate interests in displaying personalised advertising, in order to inform other users of the social network about your activities on our website and to tailor the service to your needs.
If you do not want Facebook to assign the data collected via our website directly to your Facebook profile, you must log out of Facebook before visiting our website. You can also prevent the Facebook plugins from loading and thus the data processing described above in future by using add-ons for your browser, e.g. the script blocker ‘NoScript’ (http://noscript.net/).
Facebook Inc., based in the USA, is certified under the US-European data protection agreement ‘Privacy Shield’, which ensures compliance with the level of data protection applicable in the EU.

This website uses Google Maps (API) from Google LLC., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (‘Google’). Google Maps is a web service for displaying interactive (land) maps to visually represent geographical information. By using this service, our location is displayed to you and any journey to us is made easier.
When you visit subpages that contain Google Maps, information about your use of our website (such as your IP address) is transmitted to Google servers in the United States and stored there. This occurs regardless of whether Google provides a user account that you are logged in to or whether no user account exists. If you are logged in to Google, your data will be directly associated with your account. If you do not want this to be associated with your Google profile, you must log out before activating the button. Google stores your data (even for users who are not logged in) as usage profiles and evaluates them. Such evaluation is carried out in particular in accordance with Art. 6 para. 1 lit. f GDPR on the basis of Google’s legitimate interests in the display of personalised advertising, market research and/or the needs-based design of its website. You have the right to object to the creation of these user profiles, whereby you must contact Google to exercise this right.

If your personal data is processed, you are a data subject within the meaning of the GDPR and you have the following rights vis-à-vis the controller:
7.1 Right to information
You may request confirmation from the controller as to whether personal data concerning you is being processed by us.
If such processing is taking place, you may request the following information from the controller:
1. (1) the purposes for which the personal data are processed;
2. (2) the categories of personal data that are processed;
3. (3) the recipients or categories of recipients to whom the personal data concerning you have been or will be disclosed;
4. (4) the planned duration of storage of the personal data concerning you or, if specific information on this is not possible, criteria for determining the storage period;

6. (6) the existence of a right to lodge a complaint with a supervisory authority;
7. (7) all available information on the origin of the data if the personal data is not collected from the data subject;
8. (8) the existence of automated decision-making, including profiling, pursuant to Article 22(1) and (4) of the GDPR and, at least in those cases, meaningful information about the logic involved, as well as the significance and the envisaged consequences of such processing for the data subject.
You have the right to request information about whether personal data concerning you is being transferred to a third country or to an international organisation. In this context, you may request to be informed about the appropriate safeguards pursuant to Art. 46 GDPR in connection with the transfer.
7.2 Right to rectification
You have the right to obtain from the controller the rectification and/or completion of your personal data if the processed personal data concerning you is inaccurate or incomplete. The controller shall carry out the rectification without delay.
7.3 Right to restriction of processing
You may request the restriction of the processing of personal data concerning you under the following conditions:
(1) if you contest the accuracy of the personal data concerning you for a period enabling the controller to verify the accuracy of the personal data;
2. (2) the processing is unlawful and you oppose the erasure of the personal data and request the restriction of their use instead;
3. (3) the controller no longer needs the personal data for the purposes of the processing, but they are required by you for the establishment, exercise or defence of legal claims; or
4. (4) if you have objected to the processing pursuant to Article 21(1) GDPR and it is not yet clear whether the legitimate grounds of the controller override your grounds.
If the processing of personal data concerning you has been restricted, such data may – apart from its storage – only be processed with your consent or for the assertion, exercise or defence of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the Union or a Member State.
If the restriction of processing has been restricted in accordance with the above conditions, you will be informed by the controller before the restriction is lifted.
7.4 Right to erasure
You may request the controller to erase personal data concerning you without undue delay, and the controller is obliged to erase such data without undue delay if one of the following reasons applies:
1. (1) The personal data concerning you is no longer necessary for the purposes for which it was collected or otherwise processed.
2. (2) You withdraw your consent on which the processing was based in accordance with Art. 6 (1) (a) or Art. 9 (2) (a) GDPR, and there is no other legal basis for the processing.
3. (3) You object to the processing pursuant to Article 21(1) of the GDPR and there are no overriding legitimate grounds for the processing, or you object to the processing pursuant to Article 21(2) of the GDPR.
4. (4) The personal data concerning you has been unlawfully processed.
5. (5) The erasure of personal data concerning you is necessary to comply with a legal obligation under Union law or the law of the Member States to which the controller is subject.
6. (6) The personal data concerning you has been collected in relation to the services offered by information society services in accordance with Art. 8(1) GDPR.
Information to third parties
If the controller has made the personal data concerning you public and is obliged to erase it pursuant to Article 17(1) GDPR, it shall take reasonable steps, including technical measures, taking into account the available technology and implementation costs, to inform controllers who process the personal data that you, as the data subject, have requested them to delete all links to this personal data or copies or replications of this personal data.
Exceptions
The right to erasure does not apply if processing is necessary
1. (1) for exercising the right of freedom of expression and information;
2. (2) for compliance with a legal obligation which requires processing by Union or Member State law to which the controller is subject or for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller;
3. (3) for reasons of public interest in the area of public health pursuant to Art. 9(2)(h) and (i) and Art. 9(3) GDPR;
4. (4) for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes pursuant to Article 89(1) GDPR, insofar as the right referred to in section a) is likely to render impossible or seriously impair the achievement of the objectives of such processing, or
(5) for the establishment, exercise or defence of legal claims.
7.5 Right to be informed
If you have exercised your right to rectification, erasure or restriction of processing vis-à-vis the controller, the controller is obliged to notify all recipients to whom your personal data has been disclosed of this rectification or erasure of the data or restriction of processing, unless this proves impossible or involves disproportionate effort.
You have the right to be informed by the controller about these recipients.
7.6 Right to data portability
You have the right to receive the personal data concerning you that you have provided to the controller in a structured, commonly used and machine-readable format. You also have the right to transmit this data to another controller without hindrance from the controller to whom the personal data has been provided, provided that
1. (1) the processing is based on consent pursuant to Art. 6(1)(a) GDPR or Art. 9(2)(a) GDPR or on a contract pursuant to Art. 6(1)(b) GDPR, and
2. (2) the processing is carried out using automated means.
In exercising this right, you also have the right to have the personal data concerning you transferred directly from one controller to another, where technically feasible. This shall not adversely affect the freedoms and rights of other persons.
The right to data portability does not apply to the processing of personal data necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.
7.7 Right to object
You have the right to object, on grounds relating to your particular situation, at any time to the processing of personal data concerning you which is based on Article 6(1)(e) or (f) GDPR; this also applies to profiling based on these provisions.
The controller shall no longer process the personal data concerning you unless the controller can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms or for the establishment, exercise or defence of legal claims.
If the personal data concerning you is processed for direct marketing purposes, you have the right to object at any time to the processing of personal data concerning you for such marketing purposes; this also applies to profiling insofar as it is related to such direct marketing.
If you object to processing for direct marketing purposes, the personal data concerning you will no longer be processed for these purposes.
In connection with the use of information society services, you have the option, irrespective of Directive 2002/58/EC, to exercise your right to object by means of automated procedures using technical specifications.
7.8 Right to revoke your declaration of consent under data protection law
You have the right to revoke your declaration of consent under data protection law at any time. Revoking your consent does not affect the legality of the processing carried out on the basis of your consent prior to revocation.
7.9 Automated decision-making in individual cases, including profiling
You have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or
significantly affects you in a similar manner. This does not apply if the decision
1. (1) is necessary for entering into, or performance of, a contract between you and the controller,
2. (2) is authorised by Union or Member State law to which the controller is subject and which also lays down suitable measures to safeguard your rights and freedoms and legitimate interests, or
3. (3) is based on your explicit consent.
However, these decisions may not be based on special categories of personal data pursuant to Art. 9(1) GDPR, unless Art. 9(2)(a) or (g) GDPR applies and appropriate measures have been taken to protect your rights and freedoms and legitimate interests.
With regard to the cases referred to in (1) and (3), the controller shall take appropriate measures to safeguard your rights and freedoms and legitimate interests, including at least the right to obtain human intervention on the part of the controller, to express your point of view and to contest the decision.
7.10 Right to lodge a complaint with a supervisory authority
Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work or place of the alleged infringement, if you consider that the processing of personal data relating to you infringes the GDPR.
The supervisory authority with which the complaint has been lodged shall inform the complainant of the status and outcome of the complaint, including the possibility of a judicial remedy under Article 78 of the GDPR.
